For Paying Rent

  • The tenant(s) have failed to pay the rent on the due date for the term which was approved by both parties when signing the leasing contract.
  • The tenant(s) have been defaulting on their past rental terms/ periods without any prior indication or notice at the time.
  • The tenant(s) have failed to meet one or more requirements in the leasing contract that can affect the payment of rent. This can include damages incurred to the property, or not maintaining a desired and agreed upon standard of systems in the property.

For Quitting The Commercial Lease

The 3 Day Eviction Notice for commercially rented properties can be presented in order to give the leasing parties a last chance to pay their rents when and if:

  • The tenant(s) have been defaulting on more than one rental terms without prior indication or consent of the landlord.
  • The property has been used for any illegal activities, including drug trafficking, arms dealing, smuggling, and so on.
  • The tenant(s) have damaged or caused waste in the property which has led to significant drop in its market value or has compromised one or more building materials and systems.
  • The tenant(s) have been involved in any activity that poses a health and safety risk threat to personnel working in the commercial property, or to the property itself.
  • The tenant(s) have been involved in any activity that has caused ‘nuisance’ in the property or the location of the commercial property, or the general public as a whole.
  • The leasing parties have been conducting business that is either illegal or does not conform to the state and their respective industry regulations, the result of which can lead to legal proceedings.
  • The property has been sublet to other companies or subtenants without prior approval or consent of the landlord.

After downloading the printable 3 Day Eviction Notice, the landlord will have to follow these instructions in order to present the form with compliance to the California Department of Consumer Affairs:

  • The 3 Day Notice to Pay Rent or Quit commercial premises has to be issued to the leasing parties in writing.
  • The eviction notice letter has to bear the full name of the individual, company, or organization that is leasing the property.
  • The notice should state the address of the commercial property.
  • The notice must state any dates and details of any and all incidents where the property was illegally, for illegal activities, or in any way that contradicts what the terms and conditions in the leasing contract.
  • The notice has to clearly state that the leasing parties should either pay the rent or quit the commercial leasing contract within the 3 days of the notice being served.

How to Count The Three Days

After presenting the notice to your tenant(s), you can start counting the three days from the first day that the notice was served. In case the third day arrives on a Saturday, Sunday, or a public holiday, then the three day period will conclude on the following Monday, or the following non-holiday. In other words, the three days are counted in accordance to three calendar days (as long as the third calendar day does not land on a weekend or holiday) days. For instance, if you have issued the 3 Day Eviction Notice on a Friday, then the first day will complete at the time you presented the notice to the tenant(s) on Saturday, and the 3 day period will hence conclude on a Monday (as long as your property is not in the Lancaster district, please call for more details on this).
